Please read these Terms and Conditions (“Terms”) carefully before using the CalmLoop mobile application and related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Agreement to Terms

By downloading, installing, or using CalmLoop, you acknowledge that you have read, understood, and agree to these Terms. These Terms govern your use of our Services, including any updates or modifications we may provide.

2. Description of Services

CalmLoop also includes a Screen Time Tracker feature designed to help you become more aware of your digital habits. This feature displays how much time you spend using various applications on your device throughout the day. It uses Android’s built-in UsageStatsManager API to access screen time statistics. The data is retrieved locally on your device and is never transmitted, stored externally, or shared. This tool is offered solely to support your personal efforts in reducing screen addiction and improving focus.

3. In-App Purchases and Subscriptions

Remove Ads Purchase:

• CalmLoop offers a one-time in-app purchase that removes advertisements from the app.

All Noises Access Subscription:

• CalmLoop provides a subscription option (“All Noises Access”) that gives you full access to the complete library of sounds, noises, and music.
• Recurring Subscriptions:
  Your subscription will automatically renew at the end of each billing period unless canceled at least 24 hours before the current period expires. You authorize CalmLoop to charge your payment method at the then-current rate, along with any applicable taxes.
• Cancellation:
  To cancel your subscription, please use the instructions provided within the app or through your app store account settings. Cancellations will not result in refunds for fees already paid, and your access will continue until the end of the current billing period.
• All payment transactions are processed securely through our app store partners. Please refer to their terms and privacy policies for additional details regarding payment processing.

4. Use of the Services

• Eligibility:
  You must be at least 16 years old to use CalmLoop. If you are under the age of majority in your jurisdiction, you may use the Services only with the consent and supervision of a parent or legal guardian.
• Account and Security:
  CalmLoop’s subscription features are managed directly through your app store account. You do not need to create a separate account within the app to access its basic functionalities. You are responsible for managing your subscriptions via your app store and maintaining the security of your app store account credentials.
• Permitted Use:
  You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not misuse the Services or attempt to circumvent any security or technical features.

5. Disclaimers and Limitation of Liability

• Medical Disclaimer:
  CalmLoop’s content is provided for informational and entertainment purposes only. It is not intended to diagnose, treat, cure, or prevent any disease or condition. Always seek the advice of a qualified professional regarding any medical or psychological concerns.
• No Responsibility:
  CalmLoop is provided “as is” and without any warranty or representation regarding its accuracy, reliability, or suitability. Under no circumstances shall CalmLoop, its developers, or its affiliates be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the Services.
• Acknowledgement:
  By using the Services, you acknowledge that you assume full responsibility for any results, benefits, or damages arising from your use of the app.

6. Intellectual Property Rights

• Ownership:
  All content, trademarks, logos, and intellectual property within the CalmLoop app are owned by or licensed to us. You are granted a limited, non-exclusive, non-transferable license to use the app solely for your personal use.
• Restrictions:
  You may not copy, reproduce, modify, or distribute any part of the app or its content without our prior written consent.

7. Termination

We may suspend or terminate your access to the Services if you breach these Terms or if we determine, in our sole discretion, that such action is necessary to protect our interests or those of our users. Termination of your access does not affect any accrued rights or obligations under these Terms.

8. Modifications to the Terms

We reserve the right to modify or update these Terms at any time. We will notify you of any material changes by posting the updated Terms in the app and, where feasible, via email. Your continued use of the Services following any changes constitutes your acceptance of the new Terms.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Spain, without giving effect to any conflict of law principles that would result in the application of the laws of another jurisdiction. Any dispute, controversy, or claim arising out of or in connection with these Terms or your use of the Services—including any question regarding its existence, validity, or termination—shall be exclusively resolved by the competent courts of Madrid, Spain. By accessing or using the Services, you irrevocably submit to the exclusive jurisdiction and venue of these courts and waive any objections to such jurisdiction or venue, including on grounds of inconvenience or forum non conveniens. In the event that any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Data Security:

Since no personal data is collected or stored, there are no data security or retention concerns related to personal information. Any minimal technical logs generated solely for operational purposes are not linked to your identity and are retained only for as long as necessary to maintain app functionality.

CalmLoop does not integrate with third-party services that collect personal data. However, if you choose to follow any links to external websites or services, please review their respective privacy policies as this policy does not apply to those sites.

6. Children’s Privacy

No Collection from Minors:

CalmLoop is intended for general audiences, and we do not knowingly collect any information from children. If you believe that information from a child has been inadvertently collected, please contact us immediately so that we can address the issue.
